Our competition law work focuses on:
- The enforcement of claims under competition law both before the courts and out of court, for forbearance, information and compensation (Section 8 et seq of the German Act on Unfair Competition [UWG] and Section 33 of the Restrictive Practices Act [GWB]), if a competitor has infringed competition law (e.g. by issuing a warning and/or by applying for an injunction);
- Defence of unjustified claims by competitors or consumer protection organisations, particularly defence against warnings;
- The audit of all types of advertising (e.g. websites, printed media campaigns and promotions) for admissibility under competition law;
- Defence against criminal prosecution for any offences under UWG (Section 16 UWG - Advertising incurring criminal liability; Section 17 UWG - Disclosure of trade and industrial secrets; Section 18 UWG - Use of models; Section 19 UWG - Suborning and offering).
